What this Privacy Policy covers

This Privacy Policy describes Payformix’s practices with respect to Personal Information and Anonymous Information that we collect when you use the Services. This Privacy Policy does not apply to the use of your Personal Information that is collected by third parties that Payformix does not own or control or that do not support Payformix in providing the Services.

Information we collect

In order to provide our full range of services, we may collect the following types of information:

Information you provide - When you signup for an account on (“Account”), we ask you for your e-mail address and account password.  When you contact us through our website, we ask you for Personal Information, such as your name and email address. When your usage of the exceeds the limits of the free of charge service, as further described in the Terms of Service, we may also request credit card or other payment account information which we maintain in encrypted form on secure servers. We may combine the information you submit under your Account with information from third parties in order to verify your business information, provide you with a better experience and to improve the quality of our services.

Cookies - When you visit a Payformix website, we send one or more cookies - a small file containing a string of characters - to your computer or other device that uniquely identifies your browser. We use cookies to improve the quality of our service, including for storing user preferences and managing user login sessions. Payformix also uses cookies in the to help businesses serve and manage forms across the web. User communications - When you send email or other communications to Payformix, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services.

Location data - Payformix may use location-enabled services to verify your physical location. Payformix may receive information about your actual location (such as web browser provided geolocation information) or information that can be used to approximate a location (such as a geolocation of an IP address).

Links - Payformix may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our Services and site navigation.

Other sites - This Privacy Policy applies to Payformix services only. We do not exercise control over the sites that post forms. These other sites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you.  Any Personal Information you provide to such other sites will be subject to the other site’s privacy policy and website terms of service, and not to this Privacy Policy or the Payformix Terms of Service.

How we use information we collect

Payformix only processes Personal Information for the purposes described in this Privacy Policy. In addition to the above, such purposes include:

Providing our Services, including the display of customized content;

Validating your Account information, including sending you an e-mail confirmation to verify your e-mail address;

Providing you with updates about the Services and electronic newsletters, promotional e-mails, and surveys (you may opt-out of such promotional communications as set forth in the Section titled “Choices for Personal Information”, below);

Choices for Personal Information

You may opt-out from receiving newsletters or other promotional communications from us by following the unsubscribe instructions in each applicable communication.

Despite your indicated communication preferences, we may send you administrative communications regarding the Services, send you e-mail message to the e-mail address you provide to verify that the e-mail address belongs to you, and send you notices of any updates to our Terms of Service or Privacy Policy.  You may not opt-out of these communications, which are not promotional in nature, but if you do not wish to receive these announcements, you have the option to deactivate your Account, in which case Payformix may not be able to provide the Services to you. You understand that any termination of your Account may involve deletion of your Account information from our live databases and all the information and data stored for such Account in the Services. Payformix will not have any liability whatsoever to you for any termination of your account or related deletion of you information.

When we delete information that we have collected from or about you, it will be deleted from our active databases but may remain in our archives.

Information sharing

Payformix only shares Personal Information with other companies or individuals outside of Payformix in the following limited circumstances:

We have your consent. We require opt-in consent for the sharing of any Personal Information, other than the circumstances described below.

We provide such Personal Information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing Personal Information on our behalf. We require that these parties agree to process such Personal Information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

We may provide your Personal Information to third party service providers and suppliers who provide services to us or for us, such as credit card payment processors.  However, these service providers and suppliers do not have any independent right to use or disclose this information except to help us provide the Services.

We have a good faith belief that access, use, preservation or disclosure of such Personal Information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Payformix, its users or the public as required or permitted by law.

In the event Payformix goes through a business transition such as a merger, acquisition, or any form of sale of some or all of its assets, your Personal Information will likely be among the assets transferred.  You acknowledge that such transfers may occur, and that any acquirer of Payformix or its assets may continue to use your Personal Information as set forth in this Privacy Policy.

We may create Anonymous Information records from Personal Information by excluding information (such as your name) that makes the Personal Information personally identifiable to you.  We may use this Anonymous Information to analyze usage patterns so that we may enhance the Services.  We reserve the right to use and disclose Anonymous Information to third parties in our discretion.

Information security and Data integrity

We take commercially reasonable and appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of Personal Information. Payformix processes Personal Information in accordance with this Privacy Policy. We take reasonable steps to ensure that the Personal Information we process is accurate, complete, and current, but we depend on our users to update or correct their Personal Information whenever necessary.

Accessing and updating your information

When you use the Services, we make commercially reasonable efforts to provide you with access to your Personal Information and information about your business.  We will correct this data if it is inaccurate or delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes, as set forth in this Privacy Policy. When we receive formal written complaints at this address, it is Payformix’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding Personal Information that cannot be resolved between Payformix and an individual.

Privacy of minors

We do not intentionally collect or maintain information from persons under the age of 13.

Changes to this Privacy Policy

Please note that this Privacy Policy may change from time to time. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).
